These terms (“Terms”) govern your use of usacrimemap.com (the “Site”). By accessing or using the Site you agree to these Terms and to our disclaimer and privacy notice, which are incorporated by reference. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Permitted use
You may use the Site for lawful, personal, non-commercial information purposes — for example, situational awareness about the area you live in or visit, or research and journalism. Educational and journalistic re-use is permitted with attribution to USACrimeMap and a link to the source page.
3. Prohibited use
You agree not to:
- use any data, score, grade, indicator, or output from the Site as a factor in any decision concerning credit, insurance, employment, tenancy, housing, lending, child custody, school selection, or other purpose enumerated in the Fair Credit Reporting Act (15 U.S.C. § 1681b);
- use the Site to discriminate, steer, or take adverse action against any individual on the basis of race, color, national origin, religion, sex, familial status, disability, or any other class protected by the Fair Housing Act, the Equal Credit Opportunity Act, state or local fair-housing law, or any analogous regulation;
- identify, profile, locate, contact, harass, defame, threaten, or build a dossier on any individual using information visible on or derivable from the Site;
- attempt to re-attach personally identifying information (names, dates of birth, faces, license plates) to the records on the Site;
- scrape, mass-download, automate access to, or re-publish substantial portions of the Site in a way that competes with our service, except where such re-use is independently permitted by the originating agency's open-data license (in which case you should source directly from that agency, not from us);
- interfere with the operation of the Site, attempt to bypass rate limits, run security probes without prior written authorization, or otherwise act in a manner that imposes an unreasonable load on our infrastructure;
- use the Site to violate any applicable law or regulation.
4. Intellectual property
Underlying records published by government agencies are public-domain or available under the open-data license cited on each source's page. Our presentation layer — including but not limited to the design, source code, category taxonomy, narrative copy, FAQ content, scoring algorithms, layout, and brand — is owned by USACrimeMap and protected by copyright, trademark, and applicable trade-dress law. You may link to and embed individual pages from the Site with attribution. Bulk re-use of our processed data, our scoring outputs, or our copy requires a separate written license from us.
5. Data accuracy and corrections
The Site re-publishes upstream agency data and may not reflect the most recent corrections, retractions, or sealings made by that agency. We provide a correction request process and act on substantiated requests within ten business days, typically by re-syncing from the originating agency, suppressing the record on our display layer, or both. The originating agency remains the sole system of record for any factual question. See the disclaimer for further detail.
6. “As-is”; disclaimers
The Site is provided “as is” and “as available” without warranty of any kind, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, or availability. 7. Limitation of liability
To the fullest extent permitted by applicable law, USACrimeMap, its operators, contributors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your access to, use of, inability to use, or reliance on the Site, even where advised of the possibility of such damages. Our total cumulative liability arising out of or related to these Terms or the Site will not exceed the greater of USD $100 or the amounts you have paid us in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental damages; in those jurisdictions our liability is limited to the smallest extent permitted.
8. Indemnification
You agree to defend, indemnify, and hold harmless USACrimeMap, its operators, employees, contractors, and licensors from any claim, demand, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party right. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
9. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including a violation of these Terms or a request from law enforcement. Sections that by their nature should survive termination — including intellectual-property, disclaimers, limitations of liability, indemnification and dispute provisions — shall survive.
10. Governing law and venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, and applicable federal law of the United States. Subject to §11, the exclusive venue for any action arising out of or related to these Terms or the Site is the state and federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction in those courts.
11. Informal dispute resolution
Before filing a claim against us, you agree to try to resolve the dispute informally by writing to legal@usacrimemap.com with a description of the issue and proposed resolution. We will attempt to resolve it within thirty (30) days of receipt. If we cannot, either party may proceed to formal dispute resolution.
12. Severability
If any provision of these Terms is held to be unenforceable, the remainder will continue in full effect, and the unenforceable provision will be modified to the minimum extent necessary to render it enforceable while preserving the parties' intent.
13. Changes to these Terms
We may update these Terms at any time. The “Last updated” date above reflects the most recent change. Material changes will be flagged on the Site for at least thirty (30) days. Your continued use of the Site following an update constitutes acceptance of the updated Terms.
